Procedural Posture

Civil Application / Full Court Determination on Retrospective Application of Amended Rule 32

  1. 1 Does the amended Rule 32 of the Uniform Rules of Court apply retrospectively to pending summary judgment applications initiated before 1 July 2019.
  2. 2 Is the plaintiff obliged to comply with the new Rule 32 for applications initiated before its commencement.
  3. 3 Does the absence of transitional provisions in the amended Rule 32 indicate legislative intent regarding retrospectivity.

Court Disposition

The amended Rule 32 does not apply retrospectively to pending summary judgment applications initiated before 1 July 2019; the unamended Rule 32 applies to such applications.
