Ratio Decidendi

The court found that Mr Fakude’s defence was not credible or tenable, as his alleged lack of knowledge and claims of fraud were contradicted by contemporaneous evidence and his own engagement with the process. The counter application was brought very late and was not substantiated. The execution process was complete, and the respondents had ample opportunity to oppose but failed to do so. The court rejected Mr Fakude’s version as a stratagem to delay eviction and granted the eviction order, allowing the respondents until 30 June 2017 to vacate due to their long occupation of the property.
