Ratio Decidendi

The court found that the applicant failed to act with the requisite urgency in seeking an interim interdict pending review of the tender award. The applicant was aware of its grounds for review from July 2021 but delayed instituting proceedings until February 2022, despite the contract being for only one year and nearly fully performed. The court held that waiting for the outcome of internal remedies or for a stronger case did not justify the delay. The local content complaint, even if considered a ground of review, did not overcome the fundamental lack of urgency. The application was therefore struck from the roll for want of urgency, and costs were awarded against the applicant.
