Ratio Decidendi

The applicant retains standing to enforce the contractual right to register the servitude, as the agreement between the applicant and the first respondent is not disputed and no cession or transfer of rights has occurred. The servitude area is sufficiently ascertainable from the agreement and the approved diagram, and the existence of a gravel road negates the respondent's claim of an obligation to construct a new road. Environmental authorisation is required for bridge construction, but this does not render the servitude itself unlawful or unenforceable. The respondent's defences are rejected, and the applicant is entitled to register the servitude and recover costs on Scale B.
