The court held that the Appeal Tribunal of the General Council of the Bar of South Africa did not have jurisdiction to hear the appeal because the proceedings before the KwaZulu-Natal Bar Council had not reached the stage of disciplinary proceedings. The rules of both the General Council and the KwaZulu-Natal Bar make clear that disciplinary proceedings only commence once a decision is made to prosecute a member for misconduct, following a preliminary enquiry. In this case, the preliminary enquiry resulted in a decision not to prosecute, and thus no disciplinary proceedings were instituted.
