S v Lekaota and Another (135/2014(B)) [2014] ZAFSHC 123 (14 August 2014)

The magistrate failed to comply with basic procedural requirements: the charge was not properly put to the accused, nor explained to them; the accused were convicted of common assault despite being charged with assault with intent to do grievous bodily harm, without reasons for the deviation; no reasons were given for sentence; and the accused were not given an opportunity to address the court on sentence.
