S v Mawelewele and Another (106/2001) [2001] ZANWHC 46 (1 November 2001)

The court found that, although not all procedural steps for a compensation order were strictly followed, there was substantial compliance with the requirements. The complainant gave evidence of the value of the cow, and the application for compensation was made only after conviction. The accused themselves requested the compensation order and agreed to pay more than the amount ordered. The interests of justice were served, and no prejudice was caused to the accused. The conviction was confirmed, but the sentence was set aside and replaced with a properly worded suspended sentence and compensation order in line with legal authority.
