Accused 2, however, played the lead and more violent role in the murder, had a recent conviction for culpable homicide, and showed no insight or remorse. The court held that there were no substantial and compelling circumstances to justify deviation from the prescribed minimum sentences for accused 2, but found that the psycho-social circumstances and rehabilitative potential of accused 1 justified a lesser sentence than life...
