[1] In hierdie aangeleentheid, onder ons aandag gebring deur die senior landdros van Welkom, blyk dit dat ingevolge ân skriftelike
kennisgewing om in die hof te verskyn ingevolge artikel 56(1) van die Strafproseswet, No. 51 van 1977, ân hoofklagte van bestuur sonder ân lisensie en ân alternatiewe klagte dat die lisensie nie byderhand was nie, gestel was. In die kennisgewing is ân
skulderkenningsboete van R200,00 op die hoofklagte en R100,00 op die alternatiewe klagte gestel. Die klerk van die hof het egter per abuis betaling vanaf die beskuldigde ontvang van die skulderkenningsboetes op beide die hoof sowel as die alternatiewe klagtes.
[2] In die omstandighede versoek die landdros dat die geagte skuldigbevinding op die alternatiewe klagte ingevolge artikel 57(6)
van die Strafproseswet, tersyde gestel word en gelas word dat die bedrag van R100,00 aan die beskuldigde terugbetaal word. Dit is duidelik dat in hierdie versoek voldoen moet word.
[3] Gevolglik word die skuldigbevinding die alternatiewe aanklag tersyde gestel en word gelas dat die bedrag van R100,00 aan die beskuldigde terugbetaal word.
