The Supreme Court of Appeal held that the acceptance by the prosecutor of a plea of guilty to culpable homicide in respect of an indictment for murder restricted the ambit of the case to culpable homicide. The trial court acted irregularly by proceeding to convict the appellant of murder after such acceptance. The court further clarified that proof of intention (dolus) does not exclude negligence (culpa), as the two are conceptually distinct and may coexist in the context of culpable homicide. The conviction of murder was therefore altered to culpable homicide, and the sentence was reduced accordingly.
