Ratio Decidendi

The Tribunal found that the original order confirming the debt restructuring agreement contained an obvious error in the identity number of the second consumer. This error was common to all parties and was not contested by any respondent, as no answering affidavits were filed. In terms of Section 165(1)(c) of the National Credit Act, the Tribunal is empowered to vary its order to correct such mistakes. The Tribunal was satisfied that the application was properly served and proceeded on a default basis. The variation sought was limited to correcting the identity numbers, which is permissible under the Act. Accordingly, the application to vary the order was granted.
