The Court held that the applicant company lacked legal standing to assert the rights allegedly acquired by the Sandton Civic Precinct Consortium. The November 2000 resolution awarded development rights to the consortium as a whole, not to its individual members or to the applicant company, which did not exist at the time. The applicant represented only two of the four original consortium members, with no authority or cession from the others.
