Ratio Decidendi

The Labour Relations Act prescribes specific time periods for the referral of disputes but is silent on the period for enforcement of arbitration awards. In the absence of conflicting provisions, the Prescription Act applies to the enforcement of such awards. An arbitration award constitutes a debt and prescribes after three years unless made an order of court, in which case it prescribes after thirty years. In this case, the award became due seven days after service on 9 August 2009, and prescribed on 16 August 2012.
