Procedural Posture

Eviction Application / Final Determination After Multiple Interlocutory Hearings and Compliance With Statutory Notice Requirements

  1. 1 Whether the applicant has established ownership of the property sufficient to justify eviction of the respondents.
  2. 2 Whether the procedural requirements of section 4 of the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998 were complied with.
  3. 3 Whether the respondents have any valid defence to resist eviction, including reliance on the Housing Act and alleged prior purchase from the same seller.

Ratio Decidendi

The applicant has established ownership of the property by virtue of a registered title deed and has complied with the procedural requirements of section 4 of the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act. The respondents' occupation is unlawful, and their reliance on prior purchase and the Housing Act does not constitute a valid defence, as the sale and transfer to the applicant remain effective until set aside by judicial review. The respondents have failed to disclose any circumstances that would render eviction unjust or inequitable. The applicant is entitled to an eviction order and costs.

Court Disposition

Application for eviction granted; respondents ordered to vacate property; costs awarded against first respondent.
