Although the protection order and warrant of arrest were valid, Inspector Leonard failed to properly exercise her discretion under section 8(4)(b) of the Domestic Violence Act. She did not objectively assess whether there were reasonable grounds to suspect that Ms Du Toit may suffer imminent harm, nor did she consider the mandatory factors set out in section 8(5). The arrest was effected on insufficiently substantiated grounds, without further investigation, and in circumstances where a notice to appear in court under section 8(4)(c) would have sufficed.
