Ratio Decidendi

The court found that the Minister did not have the authority to unilaterally impose the 2011 Constitution on the Services SETA or to appoint the chairperson and members of its Council. The 2002 Constitution, approved and gazetted previously, remained valid and governed the SETA. The Minister's actions contravened the Skills Development Act, which requires that members and office bearers be elected by the SETA's members. The suspension of Mr. Blumenthal by Moon was unlawful and procedurally unfair, as Moon was not validly appointed and did not follow proper procedures. Even if Moon had been validly appointed, he lacked the authority to suspend the CEO without Council or Executive Committee...
