Procedural Posture

Review Application / Application for Judicial Review Under Paja; Interlocutory Order Regarding Service

  1. 1 Whether proper service was effected on the 5th Respondent, Cousins Coal Co (Pty) Ltd.
  2. 2 Whether the court can proceed in the absence of proper service on a party with a direct and substantial interest.
  3. 3 What is the consequence of proceeding without proper service on an interested party.

Ratio Decidendi

The court found that service on the 5th Respondent was not properly effected at its current registered address as reflected in the company search report. The registered address had changed from the address used for service to a new address in Groblersdal, and proper service should have been effected there. As the 5th Respondent has a direct and substantial interest in the matter, the court cannot proceed without ensuring proper service. The proceedings against the 5th Respondent are therefore irregular and cannot continue until proper service is effected.

Court Disposition

Application stood down; applicant ordered to effect proper service on the 5th Respondent at its updated registered address or principal place of business.

Orders

  • The applicant is ordered to effect proper service upon the 5th Respondent at its registered address as updated on the company search report or at a place proven to be its principal place of business.
