Sing Li v Omega Holdings Ltd (JS 591/02) [2003] ZALC 36 (25 April 2003)
The Labour Court's jurisdiction over contractual claims is not dependent on conciliation under Section 74(2) of the BCEA unless the claims are for amounts owing in terms of the Act and linked to unfair dismissal proceedings. In this case, the applicant's money claims are founded in contract and not pleaded as claims under the BCEA. Section 77(3) of the BCEA confers concurrent jurisdiction on the Labour Court to hear such matters, and there is no statutory requirement to conciliate these claims before the Labour Court. Therefore, the respondents' jurisdictional objection fails.
