Procedural Posture

Stay Application / Application to Stay Writ of Execution Pending Review

  1. 1 Whether the execution of the writ should be stayed pending the outcome of the review application and dismissal application.
  2. 2 Whether the applicant has diligently prosecuted the review application and is entitled to relief.
  3. 3 Whether the attachment of assets was against the correct party given the identity confusion between DMG and Solartricity (Pty) Ltd.

Ratio Decidendi

The court found that although there was a possibility the award could be set aside and the applicant might suffer irreparable harm if execution proceeded, the applicant had not diligently prosecuted the review application and was largely responsible for the delay. The applicant failed to serve necessary documents and did not take steps to set the matter down for hearing. The confusion over the identity of the employer party was resolved by documentation showing Solartricity (Pty) Ltd was encompassed by DMG, making the attachment of assets proper. On the balance of convenience, the court refused relief to the applicant, but stayed execution pending the outcome of the review and dismissal...

Court Disposition

Application to stay execution granted on limited grounds; costs awarded against applicant.
