Ratio Decidendi

The court found that while Solidarity had not demonstrated a clear right to final relief compelling SAPO to pay both the employee and employer portions of medical aid contributions, it had established a prima facie case, albeit open to doubt, that SAPO may be obliged to pay both. The imminent risk of deprivation of medical scheme benefits for members could not be easily remedied retrospectively, and the harm was irreparable. The balance of convenience favoured granting interim relief. The court therefore ordered SAPO to pay the full membership contributions, including both the employer and employee portions, to Medipos for the listed members pending final determination of the application.
