Procedural Posture

Urgent Application / Application for Interim Interdict Pending Review (part A)

  1. 1 Whether the applicant demonstrated sufficient urgency to justify non-compliance with ordinary court rules.
  2. 2 Whether the applicant is entitled to interim relief interdicting implementation of the appointment of the fifth respondent as Health Risk Manager for the Eastern Cape.
  3. 3 Whether the selection process for appointing the Health Risk Manager complied with constitutional and statutory requirements of fairness, transparency, and objectivity.

Ratio Decidendi

The court found that while the applicant's right to just administrative action under section 33 of the Constitution and PAJA was infringed by an arbitrary and non-transparent selection process, the requirements for interim relief were not met. The applicant failed to demonstrate irreparable harm, as any harm to its commercial interests could be addressed in subsequent review proceedings. The balance of convenience did not favour granting an interdict, as suspending the appointment would disrupt essential health risk management services for the province and prejudice public administration. The applicant retained the right to pursue review proceedings but was not entitled to interim relief....

Court Disposition

Application for interim relief refused; costs awarded against the applicant.

Orders

  • The application for interim relief in terms of Part A is refused.
  • The applicant is liable for the costs of the State Respondents and Alexander Forbes in relation to the proceedings under Part A, including the costs of two counsel where so employed.
