Papane was therefore to be treated as a non-member for jurisdictional purposes, and the CCMA had jurisdiction to entertain his unfair dismissal dispute. Regarding condonation, the court found that the delay in referral was fully and adequately explained by the confusion over Papane's union membership and the failed attempts to arbitrate.
