The Commissioner erred by failing to analyse the evidence and by incorrectly categorising the conduct as poor performance rather than misconduct. The charges and supporting evidence, if proved, could justify dismissal for misconduct. The Commissioner did not properly address whether the conduct was serious enough to warrant dismissal, nor did he adequately consider procedural fairness or the appropriateness of reinstatement. The award was not justifiable in relation to the reasons given and failed to comply with the requirements of the Labour Relations Act. The matter should be remitted to the CCMA for proper consideration by a different Commissioner.
