Ratio Decidendi

The respondent failed to comply with the prescribed regulatory requirements for closing her legal practice and removing her name from the roll of practising attorneys. Although she did not act dishonestly or misappropriate trust funds, her failure to follow the prescripts to the letter resulted in the application against her. The applicant, as custos morum of the profession, cannot be expected to accept documents unless submitted in the prescribed form. Accordingly, the respondent is liable for the costs of the application on the attorney and client scale, including the costs of 3 August 2023.
