The applicants failed to provide any meaningful details regarding their follow-ups with their attorneys, and SAMWU did not offer any explanation for the delay. The court held that the delay should be imputed to both Marageni and SAMWU. Furthermore, the incomplete record of proceedings was not addressed by the applicants, which in itself would have precluded the review application. The non-joinder of the Bargaining Council in the supplementary affidavit was a defect, but not fatal...
