The Labour Court found that the applicant's five-week delay in filing the review application was substantial and the explanation provided was inadequate and unsatisfactory. The applicant failed to attach supporting documentation and confirmatory affidavits, rendering much of its evidence hearsay and inadmissible. Internal SAPS procedures and procurement policies were not acceptable reasons for the delay, and the applicant did not substantiate its prospects of success in the review.
