Ratio Decidendi

The court found that the third respondent failed to establish that she was dismissed in terms of section 186(1)(b) of the Labour Relations Act. The evidence showed that Yates did not have the authority to bind the applicant to a contract renewal, and English, who had such authority, did not approve the renewal. The third respondent's reliance on Yates's alleged promise was not reasonable, and the requirements for estoppel were not met as Yates lacked authority. Consequently, the CCMA did not have jurisdiction to entertain the dispute, and the arbitration award was set aside.
