The Labour Court found that the Commissioner failed to rationally and justifiably assess the fairness of Mr van Boven's dismissal. The dismissal was based on temporary incapacity due to an unpaid fine, which could have been remedied had the employer provided reasonable opportunity or assistance. The employer did not take steps to avoid dismissal, such as offering time to pay the fine or lending the money. Therefore, the dismissal was both substantively and procedurally unfair. The appropriate remedy was compensation equivalent to two months' wages, as reinstatement was not feasible given Mr van Boven's subsequent employment.
