Ratio Decidendi

The court held that compliance with section 129(1) of the National Credit Act requires not only dispatch of the notice but also proof that it was delivered to the correct post office and probably reached the consumer. Where the track and trace report shows the notice was returned to sender or not collected, the statutory requirements are not met. Discrepancies between the address and the post office reflected on the track and trace report can be resolved by an official letter from the South African Post Office confirming which post office serves the relevant address. Such a letter is sufficient supplementary evidence to establish delivery for the purposes of section 129.
