Procedural Posture

Leave to Amend / Application for Leave to Amend Particulars of Claim

  1. 1 Whether the applicant should be granted leave to amend its particulars of claim to substitute the date of the agreement and introduce new statutory allegations.
  2. 2 Whether the proposed amendment is bona fide or intended to evade the application of the National Credit Act.
  3. 3 Whether the amendment would render the particulars of claim vague, embarrassing, or excipiable.

Ratio Decidendi

The court held that the purpose of the amendment is to place the correct facts before the court for proper ventilation of the dispute. The factual dispute regarding the date of the agreement is for the trial court to determine, not for resolution in an amendment application. The respondents failed to demonstrate mala fides or prejudice that cannot be cured by a cost order. The objections regarding vagueness and embarrassment were not substantiated and did not relate to the whole cause of action. Rule 28(8) provides a mechanism for affected parties to adjust their pleadings after an amendment. Accordingly, the application to amend was granted.

Court Disposition

Leave to amend granted; costs awarded to respondents.

Orders
