Procedural Posture

Civil Appeal / Appeal From First Instance Judgment

  1. 1 Whether claims 17, 18, and 19 of South African Patent No. 2002/2337 are novel or anticipated by prior art.
  2. 2 Whether the patent should be revoked for lack of novelty.

Ratio Decidendi

The court held that the claimed invention was not confined to authorising only single transactions but extended to authorising multiple transactions at the selection of the account holder. As a result, claims 17, 18, and 19 were not novel and were invalid. The patent was therefore revoked, and the respondent's action was dismissed.

Court Disposition

Appeal upheld; respondent's action dismissed; patent revoked.
