The alleged second Progress Payment Request (C60) was never received or processed by the plaintiff, and thus did not extinguish the defendant's liability. The court rejected the defendant's argument that Kim was authorised to sign CI and found the oral agreement to repay binding. The counter-claim for damages was dismissed due to lack of evidence....
