Ratio Decidendi

The applicant relies on an overdraft agreement that expired on 22 April 2013 to claim monies lent after that date. The applicant has not set out why it is entitled to rely on an expired agreement or provided evidence of a subsequent agreement or review of the facilities. Without such evidence, the applicant has failed to make out a case against Eravin and, consequently, against the sureties. The application cannot be granted on the current papers, but the matter is postponed to allow the parties to file supplementary affidavits addressing these deficiencies.

Application postponed for further affidavits; costs of the day awarded against the applicant.
