Procedural Posture

Civil Application / Judgment on Opposed Motion

  1. 1 Whether the applicant is entitled to delivery of the movable property described in the notice of motion.
  2. 2 Whether the respondents can rely on a lien or right of retention to resist delivery.
  3. 3 Whether there was a misjoinder of parties due to changes in trusteeship.

Ratio Decidendi

The court found that the applicant was entitled to delivery of the movable property described in the notice of motion. The respondents failed to establish a valid lien or right of retention, as they were not in possession of the goods. The Trust, having lost possession, could not rely on a lien to resist the applicant's claim. The misjoinder argument was rejected, as the applicant could not have known of changes in trusteeship at the time of the founding affidavit. The applicant was awarded costs on the attorney and client scale, including reserved costs and costs for two counsel, as the matter warranted such an order.

Court Disposition

Application granted. The respondents are ordered to deliver the specified movable property to the applicant, failing which the sheriff is authorised to attach and deliver the goods. Costs awarded on the attorney and client scale, including costs for two counsel and reserved costs.

Orders

  • The first and third respondents (in their capacities as Trustees of the PJS Familie Trust), alternatively the fifth respondent, are ordered to deliver forthwith to the applicant the specified movable property listed in paragraphs 16.1.1 to 16.1.14.
  • Failing delivery, the sheriff of the court is authorised and directed to attach the goods wherever found and deliver them to the applicant.
