The arbitrator failed to properly consider whether the fourth respondent met the advertised requirements for the post, specifically the requisite NQF 6 qualification and three years of managerial experience. The evidence showed that the fourth respondent only had a matric qualification (NQF 4) and did not demonstrate the required managerial experience. The shortlisting and appointment were therefore irregular. However, the applicant is not automatically entitled to a protected promotion, as the panel's recommendation indicated that another candidate, Captain Mhlongo, was next in line.
