Procedural Posture

Urgent Application / Application to Compel and Review; Decided in Chambers on the Papers

  1. 1 Whether the applicant made out a proper case for the replacement of proportional representation councillors on the party list.
  2. 2 Whether the notification to the Municipal Manager complied with section 27(2) of the Municipal Structures Act.
  3. 3 Whether the Electoral Commission can be compelled to amend its records and effect the requested changes.

Ratio Decidendi

The application was dismissed because the applicant failed to establish that the persons it sought to substitute in the Commission's records were properly appointed or elected, and that those it sought to remove were properly ousted. The applicant did not provide sufficient evidence that the notification to the Municipal Manager was made by an authorised representative as required by section 27(2) of the Municipal Structures Act. The urgency was self-created, and the application was brought out of time. The Commission could not be compelled to act in the face of an unresolved internal party dispute, and no valid case was made out for the relief sought.

Court Disposition

Application dismissed with no order as to costs.
