Procedural Posture

Civil Trial / Final Judgment

  1. 1 Whether the disclosure of the plaintiff's confidential medical information by the defendants was unlawful.
  2. 2 Whether the disclosure violated section 14 of the Constitution and/or section 14 of the National Health Act.
  3. 3 Whether the plaintiff consented to the disclosure of his medical information.

Ratio Decidendi

The court found that the plaintiff had previously disclosed his medical condition and treatment details to Nedbank employees, thereby rendering the information non-confidential at the time the Medical Aid disclosed it to Nedbank. The statutory protections under the National Health Act and the constitutional right to privacy do not apply where the information is no longer confidential due to prior disclosure by the plaintiff. The plaintiff failed to establish wrongfulness, impairment of privacy, or intention to injure on the part of the defendants. Consequently, both the constitutional and statutory claims, as well as the actio iniurairum claim, were dismissed.

Court Disposition

Plaintiff's claim dismissed with costs.
