The court found that the commissioner failed to properly evaluate the evidence and misdirected herself by adopting a piecemeal approach. Sithole was given clear instructions to cash up by two different managers and refused on multiple occasions, which constituted gross insubordination. The commissioner failed to appreciate the seriousness of the misconduct and did not apply the reasonable decision-maker test correctly. The evidence supported the applicant's version, and the dismissal was found to be fair. The arbitration award was therefore reviewed and set aside, and substituted with a finding of gross insubordination and fair dismissal.
