The court found that the commissioner failed to properly evaluate the evidence and misdirected herself by adopting a piecemeal approach. Sithole was given clear instructions by two managers to perform cash up duties, which he refused multiple times in a disrespectful and insubordinate manner. The commissioner ignored or failed to accord proper weight to material evidence, including the applicant's witnesses and the circumstances of the refusal. The court held that a reasonable decision-maker would have found Sithole guilty of gross insubordination and that the dismissal was fair. The arbitration award was therefore unreasonable and stood to be reviewed and set aside.
