The Commissioner failed to conduct a proper inquiry into the appropriateness of dismissal as a sanction, focusing only on the existence and breach of the rule. The evidence showed that the Applicant's failure to disclose her interest in a dormant company did not result in prejudice or intentional disregard of policy. The Commissioner did not consider mitigating factors, such as the lack of financial gain, the Applicant's response, and the unclear articulation of the disclosure rule. The award was therefore unreasonable and constituted a gross irregularity. The dismissal was found to be unfair, and the Applicant was entitled to reinstatement.
