Ratio Decidendi

The Constitution does not prescribe or prohibit secret ballot voting for a motion of no confidence in the President. Read with the Rules of the National Assembly, especially rule 104, section 57 empowers the National Assembly and the Speaker to determine the voting procedure, including a secret ballot where appropriate, subject to rational and purpose-driven exercise of that power to enhance accountability and protect the constitutional role of Members.
