Procedural Posture

Urgent Application / Application for Ejectment of Respondents From Student Residence

  1. 1 Does the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998 (PIE) apply to student accommodation?
  2. 2 Are the respondents entitled to remain in occupation of the Philip Kgosana residence despite the absence of current placement or registration?
  3. 3 Has the applicant met the requirements for common law ejectment?

Student accommodation is temporary, purpose-specific, and subject to annual rotation, and does not constitute a 'home' for PIE purposes. Court Disposition

Application granted. Ejectment order issued against the first to seventh, tenth, and twelfth to fourteenth respondents. No costs order.
