Ratio Decidendi

The court held that individuals who were not cited in the contempt application and were not parties to the proceedings that resulted in the court order cannot be held liable for contempt of that order. The rationale is that such individuals were not afforded an opportunity to oppose the application and were not properly served. The only exception is where an individual is cited in a representative capacity and is shown to have caused the legal entity to disobey the order. In this case, the individuals named—Daniel Mokhlo, Flip Moledi, Lazarous Matli, Francis Nxobo, and Phakiso Mhlanga—were not cited in the contempt application and therefore cannot be held liable.
