Procedural Posture

Summary Judgment Application / Hearing and Determination of Summary Judgment

  1. 1 Whether the defendants have disclosed a bona fide defence to the plaintiff's claims under the lease agreement and suretyship.
  2. 2 Whether the plaintiff is entitled to summary judgment for the liquidated amount claimed under the lease.
  3. 3 Whether summary judgment is appropriate for the unliquidated claim for holding over.

Ratio Decidendi

The court found that the defendants failed to raise any bona fide defence to the plaintiff's claims under the lease agreement and suretyship. The plea consisted of bare denials and the counterclaim was unsubstantiated, lacking detail and failing to disclose a cause of action. The claim for rental and associated charges was liquidated and supported by documentary evidence, entitling the plaintiff to summary judgment against both defendants jointly and severally. However, the claim for holding over was unliquidated and not suitable for summary judgment, and was accordingly postponed sine die. The defendants were ordered to pay costs on the attorney and client scale.

Court Disposition

Summary judgment granted in respect of the liquidated claim; summary judgment refused and postponed sine die in respect of the unliquidated claim for holding over.

Orders

  • Judgment is entered against the defendants jointly and severally for payment of R122 775,95.
  • Interest on the aforesaid amount at the prescribed mora rate from date of demand to date of final payment, both dates inclusive.
