The proviso to the definition of 'agricultural land' in the Subdivision of Agricultural Land Act was capable of and should be read as preserving agricultural-land status for land that was within a transitional council and classified as agricultural land before the first election of that council, notwithstanding later municipal restructuring; accordingly the land remained agricultural land, ministerial consent was required, and the Supreme Court of Appeal’s contrary order was set aside and the High Court order reinstated.
