Even if the indemnity existed, the particulars of claim sufficiently alleged vicarious liability in relation to the nursing staff, who are employees of the applicant. The particulars of claim, while not perfectly drafted, disclose the essence of the case and allow the applicant to plead. The quantum of damages, though globular, is not unusual at this stage and can be detailed during further pleadings. The grounds for exception are therefore unsustainable, and the application must fail.
