The court held that the second respondent did not have lawful authority to issue the closure order under section 18(1)(a) of the Roads Ordinance because there was no written delegation of the relevant powers as required by section 65(1) of the Ordinance. Authorisation or approval by the first respondent was not sufficient to satisfy the statutory requirement for written delegation. The absence of written delegation rendered the administrative action ultra vires, unlawful, and invalid. Consequently, the review application succeeded and the closure order was set aside. The court found it unnecessary to consider the other grounds of review raised by the applicants.
