They had ample opportunity to determine the relevance and availability of the requested documents but did not act with the required diligence. The respondents' objections to discovery were raised belatedly and should have been addressed at the time the order was made. The court found that the respondents' conduct was contumacious and that striking out their defence was the only appropriate remedy.
