The court found that the applicants provided overwhelming and uncontested evidence that the Zulu Royal Family of Ncapai Kamadzikane Kazulu is the only legitimate royal family entitled to identify traditional leaders for the Makaula Traditional Council. The so-called Mngcisane Royal Family was not supported by affidavits from its alleged members, and the respondents failed to raise a genuine dispute of fact. The Premier and MEC did not comply with the requirements of the Act regarding delegation and recognition of the regent, and their decision to recognise the regent identified by the Mngcisane Royal Family was invalid.
