The Supreme Court of Appeal held that once a defendant has pleaded to the merits without objecting to the jurisdiction of the magistrate's court, and litis contestatio has occurred, the defendant is deemed to have acquiesced to the court's jurisdiction. The subsequent amendment of pleadings to introduce a special plea to jurisdiction does not operate to revive a right to object that has already been waived. Section 28(1)(f) of the Magistrates' Courts Act codifies the common law principle of tacit prorogation of jurisdiction, and there is no indication that the legislature intended to depart from this rule.
